THIS IS A LEGAL AGREEMENT BETWEEN YOU AND KIANOOS LTD.
(TOGETHER WITH THE WEBSITE LOCATED AT www.kianoos.com, COLLECTIVELY, THE “COMPANY”) STATING THE TERMS THAT GOVERN YOUR USE OF THE WEBSITE.
BY ACCESSING AND USING THE WEBSITE YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS DO NOT USE THE WEBSITE. YOU MUST ACCEPT AND ABIDE BY THESE TERMS AS PRESENTED TO YOU: CHANGES, ADDITIONS OR DELETIONS ARE NOT ACCEPTABLE AND Kianoos Ltd. MAY REFUSE ACCESS TO THE WEBSITE FOR NONCOMPLIANCE WITH ANY OF THE TERMS OF THIS AGREEMENT.

The Company reserves the right to adjust the terms and conditions of this Agreement or its policies relating to the Service or Booking platform at any time, effective upon posting an updated version of this Agreement on the Service or Booking platform. You are responsible for regularly reviewing this Agreement. Continued use of the Service or Booking platform after any such changes shall constitute your consent to such changes. The COMPANY provides cleaning services, installation services, and handyman services in the UAE. When interacting with service providers, you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don’t know. By using the Service, you agree to hold the COMPANY free from responsibility for any liability or damage that might arise out of the transaction involved. KIANOOS LLC IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OF THE SERVICE. THE COMPANY WILL NOT BE LIABLE FOR ANY CLAIM, INJURY, LOSS OF VALUABLES, OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.

  • We accept payments online using Visa and MasterCard credit/debit cards in AED (or any other currency).
  • Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the United Arab Emirates.
  • Minors under the age of 18 are prohibited from registering as a User of this website and are not allowed to transact or use the website.
  • If you make a payment for our products or services on our website, the details you submit will be provided directly to our payment provider via a secured connection.
  • The cardholder must retain a copy of transaction records and Merchant policies and rules.

To the maximum extent permitted by applicable law, Kianoos LLC hereby expressly excludes any liability for any damages whatsoever (including, without limitation, direct, indirect, special, punitive, incidental, or consequential loss or damage incurred by any user in connection with the Website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it, including, without limitation, any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

In particular, Kianoos LLC is not liable for any damages or losses resulting to you or a third party from:

  • The use or the inability to use the Website;
  • Services or goods acquired through the Website;
  • Any Content displayed on the Website; or
  • A distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

By using the service or booking platform, you agree that the exclusions and limitations of liability set out in this agreement are reasonable. If you do not think they are reasonable, you must not use the service or booking platform.

Disclaimer of Warranties

YOU USE THE WEBSITE AT YOUR OWN RISK.
THE WEBSITE IS PROVIDED WITHOUT WARRANTY AND IS PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS.
THE COMPANY HEREBY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER ORAL OR WRITTEN, WHETHER EXPRESS, IMPLIED, OR ARISING BY STATUTE, CUSTOM, COURSE OF DEALING, OR TRADE USAGE, WITH RESPECT TO THE WEBSITE OR ANY SERVICES PROVIDED HEREUNDER. NOTWITHSTANDING THE GENERALITY OF THE FOREGOING, THE COMPANY SPECIFICALLY DISCLAIMS THE FOLLOWING WITH RESPECT TO THE WEBSITE:

    • THE SERVICE OR BOOKING PLATFORM (INCLUDING ANY SERVICES) WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS,
    • THE ACCURACY, TIMELINESS, SECURITY, AND PERFORMANCE OF THE WEBSITE; OR
    • FREEDOM FROM ANY ERRORS OR VIRUSES, TROJANS, WORMS, LOGIC BOMBS, OR OTHER MATERIAL WHICH IS MALICIOUS OR TECHNOLOGICALLY HARMFUL.

Indemnity

By entering into this Agreement and using the Booking platform or Service, you agree to indemnify, defend and hold harmless Kianoos Ltd. its managers, employees, and agents from any claims, actions, demands, damages, losses or attorney fees alleging or resulting from your use or misuse of the Website or any Content, your breach of these Terms of Use, your violation of any rights of cleaning services staff arranged via the Service or Booking platform or your violation of any third party’s proprietary rights, or any disputes between you and one or more users connected to or arising from the Website in any way.

Breaches of Terms of Use

  • Without prejudice to the Company’s other rights under these terms and conditions, if you breach these terms and conditions in any way, the Company may take such action as the Company deems appropriate to deal with the breach, including suspending your access to the Service or Booking platform, prohibiting you from accessing the Service or Booking platform, blocking computers using your IP address from accessing the Service or Booking platform, contacting your internet service provider to request that they block your access to the Service or Booking platform and/or bringing court proceedings against you.

Notice

The Company may give notice to you by means of a general notice on the Service, electronic mail to your email address on record in the Company’s account information, or by written communication sent by first class mail or pre-paid post to your address on record in the Company’s account information. Such notice shall be deemed to have been given upon the expiration of 48 hours after mailing or posting (if sent by mail or pre-paid post) or 12 hours after sending (if sent by email).

Enforcement of Terms of Use

The Company reserves the right to take steps the company believes are reasonably necessary or appropriate to enforce and/or verify compliance with any of these Terms of Use (including, but not limited to Kianoos Ltd. right to cooperate with any legal process relating to your use of the Website, and/or a third party claim that your use of the Website is unlawful and/or infringes such third party’s rights). You agree that the company has the right without liability to you to disclose any registration data and/or account information to law enforcement authorities, government officials and/or third parties, as the company believes is reasonably necessary or appropriate to enforce and/or verify compliance with any of these Terms of Use (including, but not limited to Kianoos Ltd. right to cooperate with any legal process relating to your use of the Website, and/or a third party claim that your use of the Website is unlawful and/or infringes such third party’s rights).

General

  • You agree that the fact that these Terms of Use are in electronic format does not affect in any way their validity or enforce-ability.
  • These Terms of Use constitute the entire agreement between you and Kianoos Ltd. regarding its subject matter and supersede any contemporaneous or prior oral or written agreements, representations, understandings or discussions between you and Kianoos Ltd., whether implied or expressed
  • The Company’s delay or failure to exercise a right or act on a breach of these Terms of Use does not waive our right to do so in the future.
  • The provisions of these Terms of Use shall be deemed severable, and if any provision is determined to be illegal or invalid under applicable law, such provision may be changed to the extent reasonably necessary to make the provision, as so changed, legal, valid and binding.
  • This Agreement may not be assigned by you without the prior written approval of the Company but may be assigned without your consent by the Company to (i) a parent or subsidiary, (ii) an acquirer of assets, or (iii) any other successor or acquirer. Any purported assignment in violation of this section shall be void.

Refund Policy

  • Customer can cancel their order and ask for a refund 48 hours prior of booking, after this 48 hours mark there will be no refunds. This no refund policy shall apply at all times regardless of your decision to terminate your usage, the Company’s decision to terminate your usage, disruption caused to our Software or Service either planned, accidental or intentional, or any reason whatsoever. The Company reserves the right to determine final prevailing pricing. Please allow up to 45days for the refund transfer to be completed.
  • Refunds will be done only through the Original Mode of Payment.

Governing Law 

These terms and conditions are governed by and construed in accordance with the laws of the United Arab Emirates, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
